These Terms & Conditions ("Terms" / "Agreement") govern the engagement of Flip Films ("we", "us", "our") by the Client to film and produce edited video content for a Property/Project. By booking our services, the Client agrees to these Terms.

1. Engagement

The Client engages Flip Films to film the Property/Project and produce an edited film, subject to these Terms.

2. Payment Terms

  • The Client agrees to pay the Service Fee in accordance with Flip Films' price structure.

  • If payment is not made, Flip Films reserves the right to terminate this Agreement or charge a reasonable late fee. Flip Films may also recover debt recovery costs in addition to any outstanding amount owed.

  • The Service Fee covers the number of filming hours set out for the selected Property/Project. If Flip Films is required to attend for longer than agreed, an additional fee of $400 per hour plus GST applies.

3. Filming & Post-Production

  • Flip Films will nominate which of its videographers will film the Property/Project, at its sole discretion.

  • The Client acknowledges they have no right to reject the edited film on the basis of style or composition. The Client is engaging Flip Films for its technical and artistic expertise, and Flip Films reserves the right to edit the film as it sees fit, consistent with the standard of its previous work. Specific shots cannot be guaranteed, though reasonable requests will be accommodated.

  • Flip Films will select and use suitable music in each film produced.

4. Delivery of Film

  • Flip Films will use reasonable endeavours to email a first draft of the edited film within 2–7 business days of filming. The Client agrees to review and request any reasonable changes within 3 days of receiving the draft. Failure to respond within this timeframe will result in the final version being produced and sent, which will be considered final and approved.

  • The Client has a maximum of 2 revisions for an extended edit of the film. Any further editing requested after delivery of the final film will be charged at $150 per hour plus GST.

  • Upon delivery of the final edited film, the Client must notify Flip Films of any technical issues within 7 days. If no notification is received within this time, the Client is deemed satisfied, and the film and raw footage may (at Flip Films' sole discretion) be erased from Flip Films' files. Once erased, footage is unrecoverable.

5. Copyright & Rights Granted

  • Flip Films retains all ownership (including copyright) in the film and all unedited footage or photographs captured during filming, throughout the world, in perpetuity.

  • Subject to receipt of the Service Fee in full, Flip Films grants the Client the right to use the film for promotional and marketing purposes only, with respect to the Property and the Client's business.

  • Any other use of the film or unedited footage requires Flip Films' prior written consent. The Client is not entitled to edit, adapt, or modify the film in any way without Flip Films' prior written consent.

  • Flip Films may use all or part of the film, unedited footage, or stills for its own promotional purposes, including on its website and social media platforms.

6. Cancellation Policy

  • If the Client cancels or changes the filming date more than 24 hours before the scheduled Filming Date, a cancellation fee of $50 plus GST applies.

  • If the Client cancels or changes the filming date less than 24 hours before the scheduled Filming Date, a cancellation fee of 25% of the full Service Fee applies.

  • The parties may agree to reschedule the Filming Date; however, if the Client wishes to reschedule more than once, a rescheduling fee of 10% of the full Service Fee applies.

  • If the Client no longer requires post-production after the Filming Date has occurred, a cancellation fee of 75% of the full Service Fee applies.

7. Limitation of Liability

  • Flip Films is not liable for production issues during filming that are beyond its control, including bad weather, accidents, poor acoustics/lighting, or interference from other people.

  • If Flip Films cannot perform its obligations (in whole or in part) due to natural disaster, illness, injury, or any other cause beyond its control, it shall have no liability to the Client with respect to this Agreement.

  • To the fullest extent permitted by law, Flip Films is not liable if unedited footage or the film is lost through camera malfunction, data loss, or otherwise lost or damaged.

8. General

  • The Client acknowledges that Flip Films accepts referrals from third parties for bookings and may pay a commission to referrers at its sole discretion.

  • Any Special Conditions agreed between the parties form part of this Agreement.

  • The person signing this Agreement warrants they have the right and authority to enter into it and will be personally responsible for fulfilling its obligations.

  • This Agreement is governed by the laws of Victoria, Australia, and each party submits to the exclusive jurisdiction of the courts of Victoria, Australia. This Agreement supersedes all previous agreements and/or representations about its subject matter, and can only be changed by written agreement.
